SC refuses to re-examine its 1992 order setting quota limit at 50%
NEW DELHI: The Supreme Court on Wednesday refused to re-examine its 1992 verdict, which put a cap of 50% on quota, turning down the plea made by various states that the ceiling fixed by court be scrapped and they be allowed to grant reservation beyond it.
A five-judge Constitution bench said that its three decade-old verdict in the Indra Sawhney case has stood the test of time and rejected the plea of states that 50% ceiling needed to be relaxed due to changed social dynamics.
The bench, comprising Justices Ashok Bhushan, L Nageswara Rao, S Abdul Nazeer, Hemant Gupta and S Ravindra Bhat, unanimously decided that the cap on reservation was fixed "to achieve principle of equality and with an object to strike a balance which cannot be said to be arbitrary or unreasonable".
"To change the 50% limit is to have a society which is not founded on equality but based on caste rule. Democracy is an essential feature of our Constitution and part of our basic structure. If the reservation goes above 50% limit which is reasonable, it will be a slippery slope, the political pressure makes it hard to reduce the same. Thus, answer to the question posed is that the percentage of 50% has been arrived at on the principle of reasonability and achieves equality as enshrined by Article 14 of which Articles 15 and 16 are facets," Justice Bhushan said in his judgment.
SCRAP QUOTA SYSTEM FULLY
it is high time, India scraps caste based reservation and goes for economic status based reservation Or makes education free and compulsory for all till 12th and post that economic support to students from economically weaker sections.
The quota system has to be abolished.
Now i wanted to be a doctor but dailed but guys of my class much worst then me became doc. Some were rich some were obc i was poor upper caste. Anyway i left india as i cant let my kid go through same strugglle.
SC should totally scrap reservations
States should instead try to abolish quota instead 60 years are more than enough,
The quality of administrative services,including medical are suffering because of this
India should abolish caste system, quota will automatically go
Reservation should solely be set at family’s financial situation.
Major cause of brain drain to overseas countries is this reservation.
Scrap quota system.. If not possible immediately then change rules.. If in a family anyone got govt job then that family not eligible for reservation quota..
All deserving students.. Please study hard and get a good job abroad... India is being pulled down to remain a 3rd world country by our own elected politicians..
Why should quota system be allowed in the first place??? That means the governments have done nothing to the improve the backward class, and have repeatedly failed!!! Shouldn't we kick out such Politicians who form governments???
I am glad that the SC has rejected the appeal of state government. Its merely a political gimmick of the political parties.
Quota System creates injustice to Bright and deserving students , I am personally a victim of this system. If we do not scrap or reduce this the knowledgeable breed of our country which is moving out will completely diminish from our system. and other countries will benefit from it.
The SC should setup a gradual reduction of this 50% in terms of 10% per decade.
Most of the states have exceeded the maxmum quota of 50%. What action is the SC going to take against the central/state govts to make them comply with their order?? SC should completely scrap quota based on caste

This system of reservation based on caste and sub caste is why India is not growing economically and socially.
While India should progress towards quota less society after 70 years of independence , our leaders are taking us towards sectarian society.
